We have to start talking about judicial reform. Immediately.
We are the country with the most incarcerated population per capita. It doesn’t mean that we have more or less crime than other countries. And actually my experience with Russia convinced me that is needed hard hand to handle big country. But even in Russia they have managed to make a reform.
Why we have judges that are like slave owners, irresponsible to anyone, without mandate and without anyone or anything to restrict them. Even the Presidents have mandate. The same has to be done in the judicial system. The same with the Prosecutors. And they have to be elected officials. Like the rest of the powerful people, the politicians. And not politically appointed, that makes the system totally politically biased and politicized. One federal judge has more power than any President. What could Trump do after was not elected. He filed hundreds of lawsuits with no result. But the judges he appointed are still there. And more powerful to decide his own fate.
The abuse of power is obvious in any level of authority. Experiments are made on what day someone with some power starts to abuse with it. I am not sure but it is around two weeks.
What about the guards in the jails. These people from the judicial system are the new slave owners. But it is even worse. The same shackles are used, like people are chained to do any activity. Russia banned using shackles on women and children. But with our definition of gender this rule will be hardly admissible.
We are the last civilized western country in the world to use the death penalty.

The whole system is not organized to restrain crimes, but instead to aggravate crime. Creating crippled families and crippled society. And nobody actually respects the Constitution. It is mass case scenario the trial to be adjourned more than six months as is in the Constitution, with another six months admissible extension. If in six months they can’t organize a trial, the case has to be dismissed. This Constitution is not written in vain. We have to read it very carefully every day, and to discuss it every day, because there is the key solution for our justice. Most of the countries in the world has Constitutional court, where any violation of the constitution can be raised. Then the judges will be more responsible about abiding it. Sometimes that court is with nine judges panel to decide the cases.
And these lengthy sentencing guidelines. How that restricts the crime. It doesn’t correct people. What is in the real world 5 million, comparing with the time the guidelines were written. Nothing. Big theft is 2000 in US. People spend more money for lunch. Of course, these guidelines doesn’t correct anyone. There are not alternative correctional instruments. Russia has alternative system for economic crimes. They divert these people to community programs and job opportunities, instead to sentence them and stamp like criminals. This is not in anybody’s interest. Do you know how many intellectual potential is lost in these jails. Don't be surprised if other countries prefer not to incarcerate people but to use their potential. Give the person opportunity, not restriction. What is value of 20 years education of an engineer if you incarcerate this person. Other nations will use that person to create value and according to its knowledge and the time the society has spent to prepare him. I have always given here the example of the neuro doctor, incarcerated by his competitors for having two nice clinics, to steal his money. And he was sentenced to 5 years when his young wife was pregnant with his first child. God forgive that judge if he needs neuro surgery one day. Or the doctor who was using his own medication for cancer that helped thousands of people. He was chased for 45 years to be indicted after thousands of his patients survived cancer and stood in his defense. The fight is not over.
And the pretrial incarceration. How it fits with the justice and the rule innocent till proven guilty. It is totally the opposite, guilty till proven innocent. And how from the jail you can prove innocence. Without access to attorney, computer, printer, documents. Most of the time justice is done on the basis of documents. How you can defend yourself from the jail and to have equal rights with the other party. This is inequality in the justice system and is against the Constitution. But it is the mass case scenario.
One example. One guy, 16 years old, stayed in Rikers Island jail in NYC for three years for stealing a backpack without a trial, after that hanged himself. Is this justice. Is this even normal? I think every normal person have to raise their voice of closing that jail. It is worse than any horror movie.
Mass shootings happen because of the crippled society, not because of the guns. The whole system is really cruel and barbaric. And it creates the same cruel and barbaric people. If people don’t respect God, family, life itself, other values, how do you expect to respect anything. If they see politicians do crimes, the justice and jurors are for sale, and justice is administered according to political and business interests of big corporations and powerful people. Corruption is in any level of the judicial system because of its irresponsibility.
Definitely we wont solve the problem by incarcerating more people. We need to cure the society. Otherwise mass shooters will stay in any corner. Governor Newsom, please, don't blame the republicans for what happened in California mass shooting these days. Better give people housing and decent living, something to love and respect, then they won't be so busy shooting. Do you remember San Bernardino mass shooting years ago. This place looks like the biggest cloaca these days, horror apocalypse of our society.
