In late November 2024, Australia became the first jurisdiction in the world to implement what is now widely known as a ‘social media ban’ on children and teenagers under 16. The ‘ban’ has attracted global attention and sparked criticism from a range of stakeholders, including social media companies, the Australian Human Rights Commission, and a host of child safety experts and advocates. In the December issue of The Law Society of Western Australia’s Brief, Bennett Associate Thomas Coltrona provides an update on the the High Court’s recent decisions in Capic v Ford Motor Company of Australia Pty Ltd [2024] HCA 39 and Williams v Toyota Motor Corp Australia Ltd [2024] HCA 38. These successful, long-running consumer class actions against car manufacturers, for breaching consumer guarantees, have helped to clarify the approach to assessment of damages for defective goods under the Australian Consumer Law. Yesterday, Dave Stewart, Bennett - Litigation and Commercial Law’s IP Principal, joined presenter Andrew Collins on ABC Perth radio’s DRIVE program to discuss Raygun: Australia’s breakdancing Olympian, her intellectual property, and her recent threat of legal proceedings against a fringe comedy show about her career. (Dave also talks about his own dance moves, deployed at family birthday parties.)

On Monday 2 December, Dr. Michael D. participated as a panellist in the Francis Burt Law Education Programme (FBLEP) Politics and Law Teacher PL Day, held at Brookfield Place. Michael joined a distinguished panel that included The Hon. Chief Justice Peter Quinlan, The Hon. Liza Harvey (former State Liberal MP and Leader) and The Hon. Alannah MacTiernan. The discussion was facilitated by Haylie Pepper from Perth College and Political and Legal Educators Association of Western Australia (PLEAWA) representative, alongside Ben Basell from All Saints’ College also representing PLEAWA.
