"The application of the law by the police, and its interpretation by lawyers and judges, is sullied by systemic racism, misogyny, the impacts of historic and ongoing genocide of Indigenous people, classism, ableism, and more. Access to justice is affected by the social location and circumstances of both the survivor and the accused. All of this plays itself out in the context of gender-based violence, including both intimate partner and sexual violence." The brilliant Pam Cross explains "Why the Law Fails Victims of Violent Partners" succinctly in The Walrus - here are some takeaways. Not to mention the high standard of proof where not only is a survivor's body, personal life and relationship to the perpetrator considered evidence but non-physical abuse is rarely considered. Proceedings can retraumatize beyond the impact of the incident. Rulings can put the survivor and their children at further risk. Survivors of sexual violence do not get legal representation and their cases have the lowest conviction rates (of 1,000 sexual assaults, 33 are reported to police, 29 are registered as a crime, 12 have charges laid, 6 are prosecuted, and 3 lead to a conviction.) All of which begs the question - is our justice system even equipped at all to handle cases of GBV? And so, is funding better placed on upstream prevention efforts - addressing root causes of violence including needed social cultural shifts to uproot misogyny, racism, ableism and homo/transphobia; multidisciplinary training and bystander interventions; culturally responsive & led survivor supports; and community safety and wellbeing planning, to actually address and end GBV? AND needed sustainable, continuous, compensatory funding for the organizations who do this work expertly??? YES. https://lnkd.in/gk4QtMts

A key part of advocacy is holding government accountable. A GBV Commissioner (one of the recommendations of the Mass Casualty Commission) would help address this. The Progress Monitoring Committee of the MCC has released their annual report but it is lacking detail on GBV-related recommendations from the MCC with no mention of a GBV Commissioner (V.17). Nova Scotia's GBV rates are among the worst in the country. We experienced 3 femicides in recent weeks and are home to the worst mass shooting in Canadian history - rooted in and began with - GBV. We are proud to have contributed to and signed this letter in a coalition of GBV advocacy organizations and individuals to Myra Freeman, Chair of the Progress Monitoring Committee who monitor the implementation of Mass Casualty Commission recommendations. Their annual progress report was greatly lacking in detail on progress on IPV/GBV-related recommendations making it hard to know where resources need to be invested, align partnership and advocacy efforts, and ensure critical resources are directed to those most affected by these issues. While NS has rightly declared intimate partner violence a provincial epidemic, we need to see commitment and action to address and #EndGBV. Government of Nova Scotia Tim Houston
