Thank you to everyone who joined us online and in-person on Wednesday night for the 2024 LALIVE Lecture, hosted by the Geneva Graduate Institute. We welcomed Professor Philippe Sands KC as our guest speaker, who shared a thought-provoking presentation on “Discomforts: A Personal Journey Across Four Decades of Investor-State Arbitration.” The lecture traced the evolution of investment arbitration through the lens of Professor Sands’ extensive experience as both counsel and arbitrator. He highlighted pressing substantive and procedural challenges facing the field, including the integration of environmental considerations, the practice of double hatting, the lack of diversity among arbitrators and counsel, and the escalating costs of arbitration. Professor Sands called for collective action within the arbitration community to address these critical issues.
