We’ll all be aware that little happens overnight in the world of planning . . . but some things are worth waiting for. Earlier this week, we received two positive appeal decisions from the Inspectorate following a recent conjoined Hearing, allowing our client, Helmsley Group, to now choose which scheme to develop on what is an under-utilised commercial site in an open countryside location in North Yorkshire’s Howardian Hills National Landscape (AONB) – one involving the redevelopment of the site with nine new-build homes or one involving the redevelopment of the site with seven new homes across a conversion and new-builds. The site had little by way of potential for residential development until our intervention in a Class O Prior Approval application in 2021 for conversion of a commercial building to ten small apartments. The Council refused that application but we appealed in 2022 and successfully demonstrated to the Inspectorate that the Council had refused it beyond the statutory 56-day period, resulting in deemed consent for that scheme of conversion, which we were then able to refer to as a fallback position in subsequent planning applications for the comprehensive redevelopment of the site for new housing. Fast-forward until last year and the Council refused both alternative schemes for residential redevelopment on the grounds of their location in the open countryside, design, landscape and noise-related impacts, though we were then successful in convincing the Inspector at the recent Hearing that, notwithstanding some conflict with the Development Plan, both proposed schemes were preferable in terms of their impacts than the consented fallback scheme. Last week, we were thrilled to secure reserved matters consent for a 65-unit residential development in Winterton, North Lincolnshire, on behalf of Scothern Construction Ltd After outline permission was granted on appeal in July 2021, our Planning team was engaged to support the reserved matters application. This journey involved close collaboration with QAD Architects, Golby + Luck Ltd Ltd, Clancy Consulting, and Local Transport Projects Ltd to develop a high-quality scheme featuring 11 unique house types across various sizes and tenures. The proposal faced significant local interest and was initially deferred at planning committee due to concerns around existing property amenity and local services. However, with some minor amendments and a swift turnaround, the revised scheme returned to committee the following month and gained approval. It’s been a pleasure working alongside such a talented project team, and we’re excited to see this fantastic development come to life!
