Here's to the end of a successful first trip to Hong Kong with Fanos Theophani and Rob Collins. Hugely enjoyed flying the Preston Turnbull LLP flag out in this exciting part of the world. Great to have had the opportunity to meet several clients in person and discuss current issues experienced by their members. A special thanks to the UK P&I Club Hong Kong team and Amy Løvseth for inviting me to present on disputes relating to cargo hold cleaning in a time charter context. In this article, we consider some of the key factors taken into account by the court when determining an anti-suit injunction application. The recent decision of Mrs Justice Dias will be of interest to shipping practitioners, in relation to proceedings commenced outside the scope of an agreed jurisdiction clause. The court noted that, absent any strong reasons to the contrary, an English court will look to hold the parties to an English law jurisdiction agreement where anti-suit relief is sought promptly.   Fanos Theophani, Cate Baddeley and Emilie Bird of Preston Turnbull LLP acted for the successful claimant. https://lnkd.in/ee44Tgir
