While social media has transformed the way that we communicate, it has also opened new avenues for deception. Catfishing, where an individual creates a false online identity to deceive another into having a romantic relationship with them, is one such example. The story of one victim Kirat Assi, as told in the podcast and Netflix documentary Sweet Bobby, highlights the profound emotional distress and harms that can be suffered by victims. The Lord Chancellor today announced a 'once-in-a-generation review' of the criminal courts, which aims to tackle the significant backlog and speed up the delivery of justice. In response, our Partner Matthew Hardcastle said: "A review of the criminal court system is welcome, but it cannot become a diversion from the issues at hand or for the need for immediate support for the criminal justice system. "The proposed introduction of an intermediate court is not a simple exercise and it is akin to spending time and energy designing a new ship while the current vessel is sinking. It offers a way forward, but it is of little use if the holes in the hull mean that you are sunk before the new ship is sea worthy. "There are many aspects to a new intermediate court to consider – not least how appeals would work, rights of audience, and funding. The danger is this review exercise is seen and presented as a silver bullet by the Government when not only is it a distraction from present woes but it could also create as many issues as it solves. The government has pledged significant funding to combat tax fraud with hundreds of new HMRC investigators set to be appointed. However, with the number of investigations into serious tax fraud at a record low, questions are being raised about HMRC’s ability to deal with the most complex cases. In a recent Law360 article, David Sleight comments: "Offshore avoidance and evasion cases are notoriously difficult to investigate and enforce. It is inevitably going to take some time for new officers to get up to speed and to be sufficiently competent to undertake these complex investigations." The UK Home Office has released guidance on the corporate criminal offence of failure to prevent fraud, and confirmed the law will take effect on 1 September 2025. This law holds large organisations accountable for fraud committed by employees or other associated persons, regardless of senior management’s awareness and with an emphasis on organisations putting in place proportionate compliance procedures. The guidance also encourages whistleblowing as a vital tool in uncovering fraud.
