Future "Department of Government Efficiency" (DOGE) leader Elon Musk sparked an online uproar last week with his call to eliminate the Consumer Financial Protection Bureau (CFPB). In a statement for Law360, Clark Hill Law Member Joann Needleman acknowledged that lawmakers should take a "fresh look" at how financial federal regulatory agencies may overlap, but she advised “[it] is unwise to leave a regulator vacuum at the federal level only to have the states fill in with inconsistent guidance and enforcement." The European Union’s new Corporate Sustainability Due Diligence Directive (CS3D) will expand oversight of third-party suppliers to address human rights violations. Risk and compliance specialists have raised concerns about the challenges of conducting due diligence, citing the perceived subjectivity of what constitutes a human rights violation. In a recent article, International Trade and Business and Human Rights Associate Sally Alghazali clarifies, “The CS3D refers to international standards adopted by the United Nations Human Rights Conventions and other international labor organizations.” Corporations may want to begin evaluating their current practices against these standards as “[it] will take time to set up a compliance framework for the CS3D and other countries are considering similar supply chain requirements,” says Alghazali.
