The U.S. Supreme Court’s recent decision in Muldrow v. City of St. Louis, MO has impacted the way we may litigate Title VII matters. Title VII of the Civil Rights Act of 1964 prohibits employment discrimination based on race, color, religion, sex (including pregnancy, childbirth, sexual orientation, and gender identity), or national origin. The decision changes the standard that determines what degree of harm makes such discrimination unlawful, reducing the threshold in favor of the plaintiff.
