As part of our efforts to reduce the Operational Carbon of our buildings now and long into the future we have been implementing industry-leading Green Lease Clauses across our projects. Collaborating closely with Maples Teesdale LLP, we've been enhancing our Green Lease Clauses for our Paradise Project. Recently, we had the opportunity to discuss the development and implementation of these clauses with Anastasia Klein, Head of ESG at Maples: “Green leases have evolved – we look beyond EPC provisions and environmental forums, to clauses that cover things like the collection and use of data, maintenance or achievement of green certifications, waste reduction and use of green energy or recycled material”. “Collaboration between owners and occupiers, particularly in the most aspirational sites, is essential and green lease provisions offer a solid starting point and clear statement of intent”. We wholeheartedly agree, and we will continue to work with Maple Teesdale to set the standard and enact Green Leases in our projects. Great work from Daniel Mead and Maples Teesdale LLP . While we’re focused on improving embodied carbon particularly through the use of #masstimber, carbon in use is far from a ‘done deal’. In the realm of hyper-efficient buildings the next battle is incentivising tenant behaviour and making sure our buildings are used to their optimum design parameters. Green leases in non-domestic buildings are an initiative being developed by the Better Buildings Partnership (BBP), a not-for-profit collaboration between leading property owners. But what's so green about them? At one end of the scale, they can be little more than acknowledgement of shared environmental values between landlord and tenant, with no obligations arising from them. At the other, they can use tenancy clauses and existing statutory regulation to hold both landlords and tenants to specific legal obligations on everything from waste reduction to the use of sustainable building materials. If you're a tenant of a non-domestic building, or about to become one, you may find that your landlord wants you to sign up to a green lease. Should you comply? Green leases have been developed to encourage more sustainable behaviours on the part of both the landlord and the tenants, which is definitely a positive move, but before you sign up, it's important to understand the detail, including the following points, amongst others: ❇️ A green lease may range from a simple acknowledgement of shared values to a legally binding set of sustainability obligations ❇️ Complying with a green lease can have financial impacts ❇️ Some landlords may, for reputational reasons, choose not to deal with tenants who won't sign up to a green lease ❇️ Green leases aren't a legal requirement, but they can strongly reinforce existing statutory obligations around EPC, MEES, etc. Want to learn more about what green leases could mean for you? A hugely gratifying day yesterday being amongst peers who share in the commitment to deliver net zero buildings and limit our impact on the climate. BUT this message must go further, deeper and up the chain to central government. It needs to be at the heart of policy making both top down, and bottom up. There is real ambition from local authorities to deliver on their climate emergencies and reach net zero before 2050 but what's clear is that they are totally stymied by the December 2023 WMS for as long as it's in place. The WMS has no place in democratic policy making, especially as it was made so undemocratically under the previous government. There is a clear opportunity to retract this and strengthen the forthcoming NPPF. If the government wants to build 1.5 million homes, then they have to be homes for for the future - and that's net zero carbon! Well done to Alex McCann for putting this so succinctly - it is a pleasure to be working alongside you and Bioregional and fighting the good fight! Also a huge thank you to the TCPA for organizing and allowing our voices to be heard in Westminster.
