This year's commemoration of the Child Safeguarding week comes at a time when Zimbabwe on 18 September 2024 gazzetted the Criminal Laws Amendment (Protection of Children and Young Persons) Act, 2024. The Bill was gazetted following the tabling of a report by the Legal Parliamentary Portfolio Committee to patch the legal lacuna then existing in the Criminal Code undermining the maximum protection of Children in line with international treaties and protocols. The amendments to Zimbabwe's Criminal Law enhances maximum protection of children and young persons. It stems from public consultations held between May 6 and May 11, 2024, in accordance with the constitutional requirement for public engagement in lawmaking. The primary focus was on redefining the age of consent and addressing issues related to child protection. Key Highlights Constitutional Context The Act aligns the definition of "young person" with the Constitution, which defines a child as anyone under 18 years. Public Consultations The committee engaged with 866 people across Zimbabwe, with a diverse representation in terms of gender and disability. General Consensus A majority supported raising the age of consent from 16 to 18, reflecting the constitutional definition of a child. Specific Amendments Clause 3 Amendments to definitions related to "extra-marital sexual intercourse" and "young person" were well-received. Clause 4 Repeal of section 70 of the Criminal Law Code was supported, with the introduction of a "Romeo and Juliet" clause to allow some consensual relationships among young persons under specific circumstances. Clause 8 Proposal to criminalize the deliberate transmission of HIV was contentious; some supported it while others opposed it based on previous agreements to decriminalize such actions. However the new act re-introduced it. Clause 11 Amendments aiding children and individuals with hearing challenges in court were positively integrated. Committee Observations Overall public support for the amendments, although some young males expressed opposition to the increase in the age of consent. Conclusion The Act is publicly viewed as a progressive step to protect children and young persons from sexual exploitation, while also safeguarding the rights of young individuals in consensual relationships. This ammendments to to the act exhibits (i) the responsiveness of the Government of Zimbabwe in addressing protection issues by firm legal safeguards and (ii) the utmost importance of public involvement in legislative processes and the ongoing efforts to align laws with constitutional protections for children.
