Why? 🤔 The unfair trading practices Directive only applies to the sale and purchase of food products, not food services, leading to asymmetry in rights and obligations, particularly concerning payment terms and late payments by public authorities. Extending the scope of the Directive to include the provision of food services will ensure fair contractual relations and protection for the #ContractCatering sector. 📰 Changes to the Food and Grocery Code of Conduct to be implemented from April 1, 2025. On November 28, both Houses of Australian Parliament (Australian House of Representatives and the Senate) passed the Bill, making significant changes to the Food and Grocery Code of Conduct. New changes will come into effect on April 1, 2025, and will: 1️⃣ Make the new Code mandatory for all retailers and wholesalers with the annual turnover above $5B (current Code of Conduct passed in 2015 is voluntary, and applied only to retailers and wholesalers that agreed to be bound by it). 2️⃣ Introduce unprecedented penalties for the breaches of the Code (the highest corporate penalties under any industry code). 3️⃣ Increase funding for and entrust ACCC to "issue infringement notices where it has reasonable grounds to believe that a supermarket has breached the Code". ⁉️ Will the new mandatory Code of Conduct achieve the intended goal and help to ensure fairer treatment of suppliers, farmers, and Australian consumers? And the plot thickens.......Commissioner Jones, do you have any thoughts on this proposed legislation? Secretary Becerra, Why delay the installation of 204 for the Retailers and weaken it's purpose? The Wholesale Distributors are the ones doing the heavy lifting. Can HHS provide suppliers with guidance and resources to help comply with the law? The restaurants have the easiest role in FSMA Sec. 204. The TLC's will be listed on their delivery invoice. The retailers will have the KDE's and CTE'S regardless. The goal is to make our food system safer and more transparent, beginning to end, and back.
