HR compliance 101 for SMEs 1. Employment Contracts It is advisable to provide your employees with an Employment Contract that meets the requirements of the Basic Condition of Employment Act. Without a contract of employment, either party will struggle proving particulars of employment, should a dispute arise. 2. Workplace Disciplinary Code This code establishes the rules regarding misconduct in the workplace and the process to be followed when employees breach the rules. It is important that your employees are made aware of the disciplinary code. The best way to do so, is to attach a copy of the disciplinary code to the contract of employment on issue to new employees. 3. Consistency & procedure It is crucial that you apply disciplinary action consistently. This means that you should treat all employees equally for committing the same misconduct. You are required to be both procedurally and substantively fair in your decisions. In other words, following the right procedure and having good reason to support the action taken. Whilst there’s an overhanging threat of litigation surrounding HR compliance, or lack of, the best way to think of it is it’s all about fairness. Once you have systems in place that protect fairness then you’re over half way there. Here are our top tips to staying ahead of any consequences of non-compliance: - Understand the UK legal requirements in relation to recruitment, contracts, working hours, pay, discrimination, and health and safety. - Familiarise yourself with the risks of non-compliance. Understanding the possible severity of consequences can help encourage focus and motivation to stay on top of everything. - Stay informed by keeping abreast of updates via government websites, legal publications, and keeping in touch with your professional partners. . - Implement good people policies and communicate them effectively to all employees. - Up-skill HR Staff and your managers on employment law principles, including anti-discrimination laws, disciplinary procedures, and employee rights. - When in doubt, seek advice from HR professionals (ahem look no further 😊) with expertise in employment law to ensure compliance and mitigate legal risks effectively.
