The New York Clean Slate Act went into effect last month. Under the Act, certain criminal conviction records will be automatically sealed after a specified period of time. The Act also requires employers to disclose more criminal history information obtained in connection with employment decisions. When making hiring decisions, employers may want to consider the backgrounds of applicants for a variety of reasons. Under federal law, employers must provide notice (in writing) that information uncovered in a background check may be used to inform decisions about employment.
