👉 Last week, IDLO - International Development Law Organization was a proud co-producing partner of the UN regional conference on people-centred #justice #PCJ2024 in Bangkok 🇹🇭, with UNDP UN Women UNEP Pathfinders for Peaceful, Just and Inclusive Societies Thailand Institute of Justice World Justice Project and others. 300+ leaders, experts, and practitioners from across the #Asia-#Pacific region gathered to share good practices that strengthen justice systems. 🔎 IDLO hosted a panel discussion on diverse pathways to justice, focusing on the role of customary and #informaljustice actors in strengthening access to justice in #Asia and the #Pacific. Moderated by our own Siavash Rahbari, distinguished panelists drew on case studies from Nepal, the Philippines, Solomon Islands, Thailand, Timor-Leste, and elsewhere in the region. 💭 Four key insights from the session: 1️⃣ Customary and informal justice actors and practices must be seen as part of the overall infrastructure of each country’s justice system—rather than apart from it 2️⃣ Empowering the most marginalized and excluded people to claim their rights and resolve conflicts is best achieved through justice pathways that are closest to communities 3️⃣ Promoting respect for basic human rights norms, and fostering monitoring and accountability, are indispensable ways to ensure customary and informal justice systems grow more people-centred 4️⃣ Diverse pathways to justice can strengthen the rule of law overall, by enabling people to use justice services that are locally-rooted, culturally-sensitive, and responsive to the needs of communities IDLO is committed to working with partners in the region to enhance #accesstojustice and #ruleoflaw, including through rights-based engagement with customary and informal justice systems, and looks forward to future collaboration with panel speakers and co-hosts. "Timor-Leste’s justice journey has been both inspiring and instructive. From the early days of independence, when the country had no judges, prosecutors, or public defenders, to its current network of courts, including four district courts and a Court of Appeal, the nation has come a long way. Yet, the #legal system, largely shaped by UNTAET regulations, requires further modernization." Bruno Lencastre shares the journey of legal system development in Timor-Leste. Tomorrow at the Asia-Pacific Ministerial Conference on the #Beijing30 Review, UNDP in Asia and the Pacific and the International Women's Rights Action Watch Asia Pacific will be co-organizing a session titled “Advancing Women’s Access to #Justice in Asia and the Pacific: Balancing Parity and Empowerment”. Date: Thursday, 21 November Time: 13:00 - 14:15 Bangkok Time Venue: Theatre, Ground Floor, UNCC The session explores barriers to justice for women across Asia and the Pacific, with a special focus on women workers. The panel will feature insights from the #judiciary, women’s rights advocates, and #gender development experts. 📊 Studies have shown that when women judges are part of the bench, outcomes improve for women plaintiffs and defendants. From cases of gender discrimination to family law, female judges are statistically more likely to deliver rulings in favor of gender equity. 🔍 Data from countries with higher percentages of women judges reveal: ✅ Increased conviction rates in sexual violence cases ✅ Improved enforcement of protective orders in domestic violence cases This demonstrates the transformative role women judges play in shaping a judiciary that is more inclusive, equitable, and responsive to the unique challenges faced by women. “Access to justice that is fair and equitable and a justice sector that works with independence, integrity, transparency and efficiency is absolutely essential to a well-functioning society. It actually strengthens the social fabric and social cohesion and it contributes to social stability and security. " Said Christophe Bahuet, Deputy Regional Director for Asia and the Pacific and Director, UNDP Bangkok Regional Hub. "The Asian experience indeed shows that the achievement of harmony and stability hinges on the empowerment of the individual to a greater extent than previously deemed feasible. The empowerment of the individual becomes key towards strengthening community balance and spearheading advancements at the community level." Said Hon. Syed Refaat Ahmed, Chief Justice of Bangladesh. Last week, over 280 participants—including government officials, judges, legal practitioners, and representatives from civil society organizations—gathered in Bangkok, Thailand, to engage in in-depth discussions and share experiences on diverse pathways to #Justice. We had a great week at #PCJ2024. With thanks to USAID, The Asia Foundation supported a justice delegation from Laos to attend the United Nations People-Centered Justice Regional Conference in Bangkok. The delegation, including representatives from the Ministry of Justice, Laos Bar Association, National Institute of Justice, and the Association for the Development of Women’s Legal Education, engaged in discussions on how to re-imagine justice systems to close the #JusticeGap. Key takeaway -- Laos is making significant strides toward promoting people-centered justice through its emerging national legal aid system. This initiative is designed to ensure access to justice for vulnerable groups, including the poor, survivors of GBV, survivors of trafficking, people with disabilities, children, and certain criminal defendants. With thanks to Suparat Fern Sawetamal Sheila Jiahuan Yuan Hatsumi SATO and the organizers of #PCJ2024 for an impactful event. Inspiring week at the People Centered Justice Conference in Bangkok! Many challenges with a widening #justice gap but also so many interesting and innovative experiences from the 27 countries taking part in the conference! #PCJ2024 Key takeaways: 💁♀️ Justice nexus issues are at the forefront of justice challenges - climate and environmental justice, digital justice, justice in crisis contexts, gender justice. 🌱 People Centered Justice places human rights, including the right to a healthy environment, at the center of justice programming. 👉The experience of marginalized populations must be at the heart of ensuring access to justice for all - including Indigenous Peoples, persons with disabilities, ethnic or religious minorities, youth, among others. 💡In the context of shrinking civic space and polarization, the law can be both a tool to protect diverse voices or weaponized to silence dissent. Upholding the independence of the judiciary becomes critical. ⭐ Access to justice for all requires addressing power imbalances. This is not apolitical and requires navigating different political and economic interest. Networking, sharing strategies and lessons, for example on strengthening legal aid, can help to build solidarity and work collectively towards turning the tide on declining rule of law across the region. 🔔 There is no one solution. There are many pathways to justice, and we need to be more creative and innovative on how we work in this space, including on alternative dispute resolution and engagement with customary justice. 💻 To ensure a people-centered approach and access for those furthest behind, including those living in crisis, it is important to understand their specific challenges and determine priorities through investment in evidence-based decision making, including collection of disaggregated data.
