A new kind of case for precedence: The ECHR has declared that Article 8 of the European Convention on Human Rights encompasses a right to effective protection by the state “from the serious adverse effects of climate change on lives, health, well-being and quality of life”. It's time to step up for governments!

Worth subscribing to Rowan to read around some vitally important subjects
The UK's ability to play a role as a climate leader internationally depends in part on the coherence between what it does at home and what it supports overseas. In this article I've written about the weaponisation of the law by governments as highlighted in a report published by Climate Rights International this week and the role this plays in undermining the UK's global climate leadership. I'm excited to be writing again. Do subscribe to my substack for more thoughts on movement organising and what supporting movements and their leaders really looks like, feminine leadership, the power of intergenerational voices, strategic communications and campaigning, protecting future generations and what it might take to shift our legal system to one that more fully protects the complex and beautiful web of life. https://lnkd.in/edzaiThF

Amazing. https://lnkd.in/gw_yA8rx AND, Berghof Foundation's Executive Director Andrew Gilmour's article in The Economist on why climate and conflict must be tackled together as defining features of our time. https://lnkd.in/efCeMgVn #climatejustice #HumanRights #conflicttransformation

The call for climate justice is growing stronger and stronger in The Hague. Read our key takeaways from day 7 of the historic climate hearings at the International Court of Justice (ICJ): - The United Kingdom, while itself stuck in its colonial past, urged the Court to ignore historical emissions when it comes to climate accountability by rejecting the longstanding customary obligation to prevent transboundary harm. It shamelessly cloaked its denial of its own responsibility in a hollow commitment to those least responsible for climate change, warping the principles of climate justice beyond recognition. This implicit dismissal of the relevance of human rights obligations was particularly disparaging, coming on Human Rights Day. - Romania followed suit, dismissing the relevance of past actions in addressing climate damage. - Peru, the Democratic Republic of Congo, and Saint Lucia sharply countered that cumulative greenhouse gas (GHG) emissions are central to a fair allocation of responsibility and reparations. - Industrialized States relied heavily on climate treaties in their quest to escape accountability, while Panama, Peru, Palau, the DRC, the Dominican Republic, and Saint Lucia underscored that climate treaties do not displace other applicable obligations under relevant duties, like prevention of environmental harm. - On a positive note, the Netherlands and Portugal emphasized the imperative to phase out fossil fuels and protect the right to a healthy environment, respectively. Outside the Court, the People’s Museum opened to amplify survivor stories. Important analysis by 5 well-respected environment NGO's active in EU policy on how the main political groups in the outgoing European Parliament and their national member parties voted on green initiatives. The EP's currently largest political group, the European People's Party (Christian-democrats) in their 2019 election manifesto wrote 'we fight climate change', however in their actual voting on climate-relevant files only scored 25 out of 100 points. No big surprises here, but still important evidence ahead of the upcoming elections to illustrate which parties can be trusted on their environmental campaign promises. And which ones simply perform a puppet show.
👀 Who are 🛡️Protectors, 🐌Procrastinators and 🦖Prehistoric Thinkers at European Parliament? 😱 Our new in-depth European Parliament Scoreboard reveals that only a minority of 2019-2024 MEPs acted as Protectors of the Green Deal. Instead, the majority were either Procrastinators or Prehistoric thinkers, delaying real climate action with patchy and inconsistent voting records, or worse, completely failing to rise to the challenge of the crises Europe is facing. ⏰ This is a wake-up call for Europeans who want to see a climate-neutral, nature-positive and socially just Europe in the future. 👉 Check out our new interactive tool: https://lnkd.in/dg_47pRk #votefutureEU BirdLife Europe and Central Asia European Environmental Bureau Transport & Environment (T&E) WWF European Policy Office
